Terms of service.

These terms are an agreement between you and bSurvey (SurveySpark) Inc. By creating an account or using SurveySpark, you agree to them. If you use SurveySpark for an organization, you accept these terms on its behalf.

1. Your account

You are responsible for keeping your login details safe and for everything that happens under your account. Tell us right away if you suspect unauthorized access.

2. Acceptable use

• Don't send unsolicited bulk messages or broadcasts to people who haven't agreed to hear from you.
• Don't collect sensitive data you have no lawful basis to collect.
• Don't try to break, overload or reverse-engineer the service.
• Follow the laws that apply to email, SMS and WhatsApp messaging where you and your recipients live.

3. Your content

You own your surveys and the responses you collect. You give us permission to host and process that content only to provide the service to you.

4. Plans and billing

Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. See pricing for current plans.

5. Availability

We work hard to keep SurveySpark available. Specific uptime commitments apply only where they are written into an Enterprise agreement.

6. Liability

To the extent the law allows, SurveySpark is provided "as is". Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

7. Changes

We may update these terms. If a change is significant, we will notify account owners by email at least 30 days before it takes effect.
